Appliance Sales & Service Terms
Dependable used appliances, clear sales and service expectations, and responsible workmanship.
Important Notice
These terms apply to used-appliance sales and to appliance inspection, diagnosis, maintenance, repair, installation, removal, movement, delivery, and related services provided by Northwest Appliances. They contain payment obligations, warranty terms, property-risk disclosures, and limitations that may affect your legal rights. Rights that cannot lawfully be waived remain in effect.
Please review these terms and the applicable written warranty before purchasing an appliance, confirming an appointment, or authorizing service. The used-appliance sales warranty is separate from the repair-service warranty in Section 13. You may request a downloadable or printed copy.
Planning to use Acima? Please tell our office when scheduling and before authorizing work that depends on Acima. We must confirm the specific program, transaction eligibility, and payment arrangement before relying on it. A service request or application approval alone does not pay the diagnostic fee or authorize a repair. See Section 4 and Section 12A.
1. Contracting Party and Agreement
“Northwest Appliances” means Simpson Maintenance LLC, doing business as Northwest Appliances, together with its authorized employees and subcontractors. “Customer” means the adult who purchases an appliance, requests or authorizes service, receives service as the appliance or property owner’s authorized representative, or signs an agreement accepting payment responsibility. The work order, approved estimate, written change orders, these Sales and Service Terms, and any applicable written warranty form the service agreement. For appliance purchases, the sales order, invoice, disclosed condition and included services, accepted sales terms, and applicable written warranty form the sales agreement. Service-only diagnostic fees and repair provisions do not override the used-appliance sales warranty.
If a manufacturer, retailer, home-warranty company, property manager, insurer, or other third party arranged the service, its authorization and coverage rules may also apply. If documents conflict, nonwaivable law and any state-required notice control first. The applicable written warranty governs warranty coverage; an order, estimate, or later website revision does not silently reduce a warranty already promised. Signed changes and transaction-specific terms otherwise control over these general terms to the extent permitted by law.
An Acima transaction also requires a separate agreement with Acima or the applicable credit provider. That agreement governs its lease or credit terms, ownership, payment schedule, and related rights, subject to applicable law. Our service authorization does not accept that separate agreement for the customer. Section 12A addresses how the transaction is coordinated with Northwest Appliances.
Used-Appliance Sales, Delivery & Returns
Northwest Appliances sells used appliances. The sales record should identify the appliance, model and serial number when available, purchase date, price, disclosed condition, included accessories, and agreed delivery or installation services. Disclosed cosmetic wear is part of the used condition; describing an appliance as used does not eliminate its warranty or lawful consumer protections.
Delivery and installation: Only services listed on the order are included. Customers must provide safe, clear access and disclose known hazards, fragile surfaces, narrow openings, stairs, and existing damage. Utility modifications, installation, connections, haul-away, and additional access work require a separate agreement if not included. Any additional charge requires approval before it is incurred. Unsafe work may be paused until conditions are corrected.
Property protection: Northwest Appliances will exercise reasonable care during delivery and authorized installation. We are not responsible for loss caused solely by pre-existing defects, unsafe building utilities, misuse, or work performed by others that reasonable care could not prevent. This does not excuse damage caused or contributed to by our failure to exercise reasonable care or exclude liability that cannot lawfully be waived.
Inspection: Please inspect the appliance and delivery area when practical, record visible concerns, and report problems promptly. A delivery signature acknowledges receipt and the visible condition observed; it does not waive hidden defects, later-discovered damage, or nonwaivable rights.
Returns and cancellations: Any voluntary return, exchange, cancellation, restocking, or delivery-charge policy must be disclosed before purchase and recorded with the sale. This section does not create an all-sales-final policy or authorize undisclosed fees. Warranty remedies and rights under applicable law remain available regardless of a voluntary return policy.
Used-Appliance 60-Day Limited Parts & Labor Warranty
Warrantor: Simpson Maintenance LLC, doing business as Northwest Appliances, 123 Federal Drive NW, Vernon, Alabama 35592. Telephone: 205-712-1056.
Appliances covered and duration: This warranty covers the used appliance identified on the sales invoice for 60 calendar days beginning on the purchase date shown on that invoice. Warranty service is provided in the customer’s home. This policy applies prospectively to purchases for which this version is provided and accepted before purchase; posting this page alone does not change an earlier sale. A prior sale retains the warranty originally promised, including an applicable 90-day warranty.
Coverage: Northwest Appliances covers parts and labor needed to correct covered defects in the appliance’s materials or workmanship that affect its normal operation during the warranty period. Coverage is for the appliance sold, not merely a previously repaired component. A different failed component is not automatically excluded.
Remedy: We will inspect the appliance and perform covered repairs without charge for covered parts and labor within a reasonable time. If a covered repair cannot reasonably be completed, we will offer a comparable replacement acceptable to the customer or a refund of the appliance purchase price and applicable sales tax. These remedies do not eliminate additional remedies required by law.
Exclusions: This limited warranty does not cover cosmetic wear disclosed before purchase or routine cleaning and maintenance. It does not cover a failure to the extent caused by misuse, neglect, overload, accident, pest damage, improper utilities, improper installation by others, external water damage, fire, freezing, power surge, or failure to follow operating instructions. These exclusions do not excuse defects present at sale or damage caused by Northwest Appliances. Use of another repair provider or replacement part does not by itself void coverage; damage caused by that work or part may be excluded.
Requesting service: Call 205-712-1056 with your purchase date, invoice or other proof of purchase, appliance identification, and a description of the problem. Report covered problems during the 60-day period and provide reasonable access for inspection. A timely reported covered claim does not expire merely because inspection or repair occurs after the coverage period. Stop using the appliance if unsafe and take reasonable steps to prevent additional damage.
In-home service and charges: Covered warranty visits are provided in the customer’s home with no trip charge and no charge for covered parts or labor. The service address is recorded with the purchase so visits can be arranged. Customers should notify us before relocating the appliance so service arrangements can be discussed; relocation alone does not void coverage. If a repair cannot be completed in the home, Northwest Appliances will discuss the repair or other applicable warranty remedy with the customer before arranging removal of the appliance; no undisclosed transport charge will be imposed. Work outside warranty coverage requires an explanation and the customer’s approval of any charge before it is incurred. General diagnostic, travel, and access-fee provisions elsewhere on this page do not impose charges for covered warranty service.
Consumer rights: This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. Northwest Appliances does not disclaim implied warranties in this document. Nothing here excludes liability or a remedy that cannot lawfully be excluded.
A paper or downloadable copy of this warranty is available upon request. Customers must have access to the complete warranty before purchase; an invoice link provided only after payment does not replace pre-sale disclosure.
2. Customer Authority and Access
The customer represents that the customer is at least 18 years old, owns the appliance or has permission from the owner or property manager to authorize service, and may grant access to the service location. An adult who is capable of making service decisions and is not impaired by alcohol, drugs, illness, or another condition must be present unless Northwest Appliances agrees otherwise in writing.
The customer must provide a reasonably safe, clean, illuminated, and accessible work area; working utilities; access to shutoffs, breakers, connections, and model and serial labels; a clear path wide enough for the appliance and equipment involved; and enough unobstructed space to open doors or panels and perform the authorized work. Children, pets, and bystanders must remain outside the work zone.
If the appliance or surrounding property is not ready or safely accessible, Northwest Appliances may delay or reschedule the work. If a technician has already traveled to the location or begun the visit, the disclosed trip or diagnostic fee remains due. The customer may prepare the area or hire an appropriate mover or trade professional at the customer’s cost.
The customer must disclose known leaks, gas odors, electrical problems, pests, mold-like growth, structural hazards, prior repairs, installation problems, water damage, and existing appliance or property damage. Northwest Appliances may refuse, pause, or stop work when conditions are unsafe, unsanitary, unlawful, abusive, outside the authorized scope, or likely to cause unreasonable damage.
3. Diagnosis and No Guaranteed Outcome
A diagnosis is a professional judgment based on symptoms, access, error codes, observable conditions, and testing available during the visit. Appliance failures may be intermittent, concealed, progressive, affected by outside utility or building conditions, or caused by multiple components.
A diagnosis or successful test is not a guarantee that every defect has been identified, that the appliance can be repaired economically, that another component will not fail, or that the same symptom will not return for a different reason. Testing confirms operation only at the time and under the conditions tested.
4. Diagnostic Fees, Estimates, and Authorization
The disclosed service-call or diagnostic fee compensates Northwest Appliances for scheduling, travel, inspection, testing, and professional diagnosis. It is earned when the technician arrives and begins evaluation, even if the customer declines repair, the reported failure cannot be duplicated, the appliance is not repairable, a needed part is unavailable, or further diagnosis is required, except where an applicable written warranty, warranty-company agreement, or law provides otherwise.
Ordinary payment: Payment is due when the diagnostic evaluation is completed unless our office approves a different arrangement in writing before the fee becomes due. After the diagnostic fee and any other amount then due are paid, Northwest Appliances will provide the diagnostic findings available from the visit and, when a repair can reasonably be proposed, the repair estimate and available parts-pricing information. Except for the Acima review process below or another agreed arrangement, Northwest Appliances may require payment before releasing the detailed report or estimate, quoting or ordering parts, reserving a return appointment, or beginning repair work. Safety findings will be communicated promptly regardless of payment. Payment of the diagnostic fee does not require the customer to approve a repair. A manufacturer, warranty-company, or service-contract authorization controls when it expressly requires a different payment or reporting process.
Acima review and diagnostic payment: Tell our office at scheduling if you expect to use Acima, and confirm the diagnostic payment arrangement before evaluation begins. We may provide the findings, itemized estimate, and parts pricing needed to assess an Acima request before collecting the diagnostic fee. Providing that information does not itself defer or waive the fee. Unless a written deferral has been approved, the fee remains due when evaluation is completed by a payment method we accept.
Any approved deferral must be recorded: The work order must identify the fee amount, payment deadline, and payment method agreed for that fee if no eligible transaction is completed. A diagnostic fee is included in an Acima transaction only when the applicable program permits it and the customer agrees. If no repair is approved, no eligible parts are needed, the application is declined, or the transaction cannot be completed, only the previously authorized fee and other authorized charges are due under the recorded arrangement. Deferral is not a promise of approval or reimbursement. A previously paid fee will be credited on the job record and will not be collected twice or added to another payment obligation without a permitted, documented adjustment. These terms do not authorize an automatic charge to a stored card or bank account.
Estimate before repair: A scheduling quote or diagnostic fee is not a final repair price. The estimate identifies the actual parts, quantities, labor, applicable tax, disclosed fees, discounts, and any diagnostic credit. It also identifies any amount to be paid separately. Northwest Appliances will obtain the customer’s authorization and confirm the required payment arrangement before ordering chargeable parts or beginning repair work. A preliminary Acima approval amount does not by itself authorize the work or guarantee that the listed charges are eligible. The final invoice may be prepared at completion, subject to approved changes under Section 6.
5. Parts and Repairs That Do Not Resolve Every Condition
Approval of a part is based on the diagnosis and information reasonably available at that time. Installing an approved part does not guarantee that an aging appliance has no additional or unrelated failure.
If an approved part does not resolve the reported condition, Northwest Appliances will stop, document the result, explain any additional findings, and request approval before installing another chargeable part. Authorized diagnostic labor, completed labor, installed parts, disclosed shipping, and disclosed nonreturnable special-order parts remain payable unless covered by a written warranty, third-party authorization, written adjustment, or applicable law. Nothing in these terms authorizes careless diagnosis, unauthorized work, or deceptive charges.
Parts may be new, remanufactured, refurbished, aftermarket, or functionally equivalent when disclosed and suitable. Northwest Appliances may decline customer-supplied parts. If accepted, no warranty applies to the customer-supplied part; any workmanship warranty is limited to the authorized installation work and excludes a failure caused by the part or its incompatibility.
For a transaction involving Acima, eligibility, payment, returns, and adjustments also follow Section 12A and the applicable separate agreement. An authorization to order a part is not confirmation that the part has been delivered or installed.
6. Change Orders
If additional parts, labor, access work, safety corrections, or cost become reasonably necessary, Northwest Appliances will pause and request written or electronically recorded approval. Silence is not authorization. The customer may decline the additional work and remain responsible for previously authorized diagnostic service, completed labor, installed or disclosed nonreturnable parts, and other approved charges, subject to a written warranty, third-party authorization, written adjustment, and applicable law.
If Acima is requested or used, a change may affect eligibility, the approved amount, or the separate agreement. Before incurring the additional charge, Northwest Appliances will obtain customer approval and confirm the permitted transaction adjustment or a separately approved payment arrangement. An added charge will not automatically be placed on an existing Acima agreement or charged to another payment method.
7. Appliance Movement, Uninstallation, and Reinstallation
Built-in, stacked, oversized, tightly fitted, corroded, improperly installed, or aging appliances may require movement, disconnection, uninstallation, reinstallation, or unusual access before diagnosis or repair can continue. The normal diagnostic or repair price does not include that work unless it is specifically listed on the approved estimate. Northwest Appliances will disclose any additional charge and obtain authorization before performing it.
The customer may move or uninstall the appliance before the appointment or arrange an appropriate mover, plumber, electrician, gas professional, cabinet contractor, or other qualified provider. Northwest Appliances may decline movement or access work that requires specialized equipment, licensing, structural alteration, excessive force, or conditions the technician reasonably considers unsafe. Declining that work does not cancel a disclosed trip or diagnostic fee already earned.
Moving an appliance can scratch, dent, crack, loosen, reveal, or worsen conditions affecting the appliance, flooring, walls, trim, cabinets, countertops, doors, stairs, hoses, valves, drains, vents, cords, wiring, gas connectors, or nearby property. Risk is increased by insufficient clearance, obstructed paths, uneven or defective flooring, brittle materials, seized fasteners, hidden leaks, corrosion, structural weakness, and prior improper installation.
When movement or unusual access is required, the customer must approve a separate Movement and Access Acknowledgment before the work occurs. That acknowledgment addresses documented pre-existing, concealed, customer-controlled, and unavoidable conditions. It does not release Northwest Appliances from direct physical damage proven to have been caused by a failure to exercise reasonable care.
8. Water, Drain, Electrical, Gas, and Vent Connections
Residual water may remain inside pumps, filters, hoses, tubs, sumps, and drain systems. Existing hoses, valves, fittings, drains, cords, receptacles, breakers, gas connectors, regulators, vents, and shutoffs may be aged, corroded, seized, defective, inaccessible, or unsuitable for reuse.
Standard appliance service assumes existing connections and shutoffs are accessible, functional, apparently safe, and suitable for reuse. Northwest Appliances may refuse to operate, disconnect, or reconnect an unsafe, leaking, damaged, inaccessible, or noncompliant connection.
Appliance service does not include modification or repair of permanent electrical wiring, receptacles, breakers, plumbing, shutoff valves, gas piping, drains, vents, cabinetry, countertops, flooring, walls, or structural components unless separately authorized and lawfully performed by a properly qualified provider.
After service, the customer must monitor the appliance and surrounding area and immediately stop use and shut off the appropriate utility when it is safe to do so if leaking, flooding, smoke, overheating, arcing, gas odor, unusual vibration, or another unsafe condition occurs.
9. Pre-Existing and Concealed Conditions
Northwest Appliances is not responsible for documented pre-existing damage or a loss caused solely by concealed, defective, deteriorated, improperly installed, customer-controlled, manufacturer, utility, building-system, or other condition that reasonable care could not prevent. Before work, the technician may photograph and document visible conditions. Failure to photograph a condition does not by itself prove that the condition did not exist.
Nothing in these terms releases Northwest Appliances from direct physical damage proven to have been caused by its failure to exercise reasonable care, or waives gross negligence, reckless or intentional misconduct, fraud, statutory rights, or liability that cannot lawfully be waived.
10. Photographs and Service Records
The customer authorizes reasonable photographs, short videos, measurements, model and serial information, error codes, and written notes of the appliance, immediate work area, access path, utility connections, existing damage, completed work, and testing results. These records may be used for diagnosis, service documentation, quality review, warranty administration, insurance, training within the service organization, and dispute resolution.
Technicians should avoid photographing people, unrelated rooms, mail, screens, and personal effects. Service records will not be used in advertising or posted publicly without separate optional marketing permission.
11. Warranty Companies and Other Third-Party Payment
Northwest Appliances is independent from manufacturers, retailers, home-warranty companies, property managers, insurers, and service-contract administrators unless the work order expressly states otherwise. Their authorization is not a guarantee of payment.
The customer is responsible for a disclosed service fee or deductible, customer-requested work outside the third party’s authorization, charges above a disclosed coverage limit, and other charges the customer separately approves. If the third party denies or reverses payment because coverage was unavailable, information supplied by the customer was inaccurate, or the customer failed to satisfy a coverage requirement, the customer remains responsible for the authorized amount after receiving an itemized invoice.
The customer is not responsible for a payment dispute solely between Northwest Appliances and a third party over the third party’s contracted provider rate unless the customer separately agreed in writing to pay it. Northwest Appliances will credit amounts received and will not collect twice for the same charge.
Acima lease or credit transactions are addressed separately in Section 12A. The coverage-denial provisions in this section do not automatically make an Acima balance payable directly to Northwest Appliances.
12. Payment, Cancellations, and Refunds
Payment is due as stated on the work order or invoice and may be made by any payment method Northwest Appliances then accepts. The customer authorizes only the approved amount, applicable tax, and separately disclosed fees. Collection costs or attorney fees will be charged only when stated in a separately signed agreement or permitted and awarded under applicable law. Card information should be processed through the payment provider and should not be included in technician notes.
Diagnostic fees are generally nonrefundable after the visit and diagnosis occur. Refunds or re-performance of labor are governed by the written warranty, a written adjustment or settlement, and applicable law. Uninstalled standard parts may be refundable when returnable, less any previously disclosed and lawful shipping or restocking charge. Special-order, installed, used, programmed, electrical or electronic, and supplier-nonreturnable parts may be nonrefundable when that limitation was disclosed before purchase and is permitted by law.
Acima transactions: Section 12A and the applicable separate lease or credit agreement govern the handling of Acima payments, returns, cancellations, and credits. General parts-return or diagnostic-fee provisions do not override rights under that agreement or applicable law.
12A. Acima, Advance Notice, and Payment Planning
Tell us before relying on Acima: Please notify our office when scheduling if you intend to use Acima or are undecided about payment. Confirm your choice before authorizing work that depends on that arrangement. If your plans change, contact us before we order parts or perform additional work. Notice allows us to review eligibility and the diagnostic payment plan; it does not guarantee that Acima will be available. A late request does not automatically convert a completed or previously paid service into an Acima transaction.
Eligibility is specific to the program and transaction: Acima is available only for approved customers and eligible transactions through a program Northwest Appliances is authorized to offer. Diagnostic calls, labor-only repairs, cleaning, maintenance, installation, service plans, and other services are not automatically eligible. Including a part does not by itself make a service eligible. Any parts-and-service combination must be permitted by the applicable program and confirmed before we rely on Acima for that work. Our itemized estimate will distinguish merchandise, labor, taxes, fees, discounts, and any amount payable separately.
Separate lease or credit agreement: If the selected option is Acima Leasing, it is a lease-to-own transaction, not a loan or credit financing. Acima purchases eligible merchandise and leases it to the customer; ownership is governed by the lease. Acquiring ownership through leasing costs more than the retailer’s cash price. If a separate credit option is offered and selected, that credit provider’s agreement governs. Availability of one option does not promise availability of another. The customer must review the actual agreement for payment amounts, total cost, ownership terms, early-purchase or payoff options, cancellation rights, and other conditions. Our invoice total is not a statement of the total cost of a lease or credit agreement.
Our policy before ordering parts or beginning repair: The customer’s application, approval amount, work authorization, and completed Acima transaction are separate steps. Before ordering chargeable parts or beginning work that depends on Acima, Northwest Appliances must confirm the transaction’s eligibility and required authorization, and the customer must complete the applicable agreement and any required initial payment at the time required by that program. Approval alone is not payment. We may pause the job if the arrangement is incomplete. Any separate customer payment must be disclosed and approved before the corresponding charge is incurred. Diagnostic fees and any approved deferral follow Section 4.
One job record; accurate charges and credits: Diagnosis, parts ordering, a return visit, and completed work may be recorded under one work order. The final invoice or job statement will show the authorized work, actual charges, approved changes, discounts, credits, prior payments, Acima-related amounts, and any remaining amount due to Northwest Appliances. Keeping one job record does not require all charges to be included in one Acima transaction. Only eligible charges may be submitted through the applicable program. We will not collect twice for the same charge, and delivery or completion will be recorded only when it actually occurs.
Payment responsibility: Payments due under a completed Acima agreement are made as directed by Acima or the applicable provider. The customer pays Northwest Appliances only the separately agreed amount, if any, that remains due directly to us. A provider funding delay, a dispute caused solely by our processing error, or a missed payment under the customer’s Acima agreement does not automatically create a second obligation to pay us the same amount. Any valid correction, reversal, or refund must be reconciled under the applicable agreements and law without duplicate collection.
Cancellations, returns, and refunds: Contact Northwest Appliances about cancelling or changing our order and contact Acima or the applicable provider about its agreement, payments, or return process. A request to one does not necessarily complete the other process. We will coordinate approved refunds, exchanges, and credits through the appropriate original payment channel and provider process, subject to applicable law. We do not promise a direct cash refund of an amount paid by Acima or its provider, and our invoice adjustment alone does not establish that the customer’s separate agreement has ended. Do not assume that a service cancellation or merchandise return stops provider payments until the applicable cancellation or adjustment has been confirmed. General nonreturnable-parts terms do not eliminate applicable lease-return or other nonwaivable rights.
Warranty and support: Choosing an available Acima option does not reduce the Northwest Appliances warranty disclosed and promised for the appliance or repair. The applicable warranty must be made available before the transaction. For a covered refund involving Acima, we will coordinate the invoice refund with the provider as described above. 13. Repair-Service Limited Parts and Workmanship Warranty
This section applies to separately purchased repair services, not the 60-day used-appliance sales warranty above. Northwest Appliances provides a 30-day limited warranty, beginning on the installation date, on the specific eligible repair labor performed and parts supplied by Northwest Appliances. Any different Northwest Appliances warranty must be disclosed before the repair is authorized. A manufacturer’s separate part warranty may provide additional coverage; it does not reduce Northwest Appliances’ own promises.
If the same diagnosed failure recurs during the warranty period, the customer must stop using the appliance when unsafe and give Northwest Appliances a reasonable opportunity to inspect. If Northwest Appliances confirms a covered defect in its workmanship or supplied part, its obligation is, at its option and within a reasonable time, to reperform the covered work, repair or replace the covered part, or refund the amount paid for the defective covered item.
The limited warranty excludes a different or intermittent failure; normal wear; cosmetic conditions; misuse, neglect, overload, accident, pests, contamination, power surge, fire, water, freeze, weather, utility defects, improper installation or ventilation, code issues, relocation, customer or third-party work, customer-supplied parts, manufacturer design defects, recalled products, and failure to follow safety or operating instructions, to the extent that condition caused or contributed to the claim.
Nothing in this warranty limits an implied warranty or remedy that cannot legally be disclaimed or limited. Any different warranty must be made available before the transaction; an invoice issued afterward does not reduce coverage already promised.
14. Completion, Safety, and Reporting a Concern
At completion, the work order should record the services performed, parts installed, tests and results, appliance status, open recommendations, safety warnings, customer exceptions, amount due, and applicable photographs. The customer should review the record and list any visible new damage or disagreement before signing. A completion signature confirms receipt and the visible condition then observed; it does not waive a hidden or later-discovered lawful claim. If the customer is unavailable or declines to sign, the technician may document that fact and Northwest Appliances will make the service record available to the customer.
For leaking, flooding, gas odor, smoke, overheating, arcing, or another urgent condition, the customer must stop using the appliance, shut off the applicable utility when safe, take reasonable emergency steps to limit additional damage, and notify Northwest Appliances immediately. For any other service or property concern, the customer should give notice as soon as reasonably possible—preferably within 24 hours after discovery—so evidence can be preserved and the condition investigated.
Notice may be given through the current telephone number, email address, text channel, or contact form shown on the work order, invoice, or Northwest Appliances website. If only a voicemail is left, the customer should also send a written message and keep a copy. Except when emergency mitigation is necessary, the customer must provide a reasonable opportunity to inspect the appliance and affected area before permanent repair, alteration, or disposal. A delayed report does not automatically waive a lawful claim, but Northwest Appliances is not responsible for additional damage that reasonable and timely mitigation would have prevented.
If Acima is used, any provider-required receipt or completion acknowledgment is separate from our work authorization and from an agreement to waive a claim. An unsigned or disputed acknowledgment will be documented accurately and handled through the applicable process. We will not ask a customer to confirm delivery or completed work before it occurs.
15. Right to Decline, Pause, or End Service
Northwest Appliances may decline, pause, reschedule, or end service for a legitimate business or safety reason, including unsafe utilities or access; pests, biohazards, severe contamination, or unsanitary conditions; threats, harassment, abusive conduct, or interference with the technician; inability to verify authority; nonpayment; requested unlawful or out-of-scope work; required licensing or equipment that is unavailable; unavailable parts; or a condition that makes a reliable repair impracticable.
The decision will not be based on a characteristic protected by law. The customer remains responsible for authorized work completed, parts installed or specially ordered after disclosure, and any trip or diagnostic fee already earned. Any unused customer payment will be handled under the refund terms and applicable law.
16. Events Beyond Reasonable Control
Neither party is responsible for delay caused by severe weather, disaster, government order, utility outage, transportation failure, supply-chain interruption, manufacturer backorder, parts discontinuation, illness, or another event beyond reasonable control. This provision does not excuse payment for completed work, a required refund, reasonable mitigation, or an obligation that law does not allow a party to suspend.
17. Governing Law and Nonwaivable Rights
For services, the law of the state where services are physically performed governs, without eliminating nonwaivable consumer rights. Appliance sales remain subject to applicable sales and consumer-protection law; nothing here displaces mandatory protections applicable to the transaction. If a provision is invalid or unenforceable, it will be enforced only to the lawful extent or severed without invalidating the remaining terms.
Certain sales first proposed in a customer’s home may carry cancellation rights and special notice requirements. When a required cancellation notice is provided, that notice controls. Nothing in these terms waives a right that applicable law makes nonwaivable.
18. Customer Information and Privacy
Northwest Appliances may receive customer information directly from the customer or from a manufacturer, retailer, home-warranty company, service-contract administrator, property manager, insurer, or other party that arranged the service. Service information may include the customer’s name, service address, telephone number, email address, appointment and communication history, appliance make, model and serial number, work-order details, photographs or video of the appliance and immediate work area, diagnosis and repair history, invoice and payment status, and warranty or authorization information.
Northwest Appliances may use this information to schedule and perform service; communicate about appointments, safety, estimates, invoices, parts, and warranties; process payment; document and improve service quality; prevent fraud; maintain accounting and business records; and handle insurance, legal, or dispute matters. Information may be disclosed as reasonably necessary to payment processors, software and cloud-service providers, parts distributors, subcontractors, professional advisers, insurers, government authorities, and the third party that arranged or pays for the work. Northwest Appliances does not sell customer personal information.
Information supplied for a manufacturer, retailer, home-warranty, service-contract, or other third-party repair does not automatically enroll the customer in Northwest Appliances’ optional communications program. Customers may affirmatively choose to receive automated appointment reminders, technician-arrival alerts, routine work-order status updates, appliance-care tips, maintenance reminders, membership information, and occasional special offers by email or text message.
Declining these optional communications does not affect the customer’s ability to purchase or receive service. Northwest Appliances may still contact the customer through a legally permitted method when reasonably necessary to schedule, perform, bill for, or complete requested service or to provide estimates, invoices, payment information, safety notices, warranty information, or responses to customer questions.
The customer may change communication preferences or revoke consent at any time.
Northwest Appliances uses reasonable administrative, technical, and physical safeguards appropriate to the information maintained, but no storage or transmission method can be guaranteed completely secure. Records are retained only as reasonably needed for service, warranty, accounting, tax, insurance, fraud-prevention, dispute, and legal purposes, and are then deleted or securely disposed of when reasonably practicable. A customer may request access, correction, deletion, or information about a record through the current contact method shown on the work order, invoice, or website; requests remain subject to identity verification and records Northwest Appliances must or is permitted to keep.
When you request Acima: We may share the contact, order, itemization, transaction-status, delivery or completion, and return or refund information reasonably necessary to process the transaction you request and administer related claims. Enter sensitive application information through the provider’s authorized secure process; do not send Social Security numbers, bank credentials, or complete payment-card information in service notes, ordinary email, or text messages. The provider’s own privacy notice applies to information it collects. Choosing Acima does not enroll you in Northwest Appliances’ optional marketing program or authorize us to share text-message opt-in data or consent for third-party marketing.
19. Changes to These Terms
Northwest Appliances may revise these terms prospectively by posting a new version and effective date. When required by law, material changes will also be communicated through an available customer contact method before they apply. A material change will not retroactively change an already authorized job, price, warranty, payment obligation, or dispute without the affected customer’s agreement unless the law expressly permits it. The version accepted for a work order or appliance purchase controls that transaction. A new 60-day sales warranty does not shorten the warranty promised on an earlier purchase.
20. Electronic Records and Acceptance
Electronic signatures, acceptance boxes affirmatively selected by the customer, recorded approvals, timestamps, emails, and text-message approvals may evidence agreement. Northwest Appliances will provide access to these terms and obtain the customer’s affirmative acceptance before an appliance purchase is completed or chargeable work begins. A website link or invoice issued only after purchase does not, by itself, establish acceptance of previously undisclosed terms. Merely viewing the website or allowing a technician to enter without receiving reasonable notice of these terms and an opportunity to review them is not, by itself, acceptance.
Consent to receive optional automated reminders, routine work-order status updates, appliance-care information, membership information, or promotional communications is not required to purchase or receive service.
The optional communications section below provides information about the program. Enrollment requires separate affirmative consent for the selected email or text channel. Accepting these terms does not enroll the customer in that program. Customers who do not enroll may still receive estimates, invoices, payment notices, safety information, warranty information, and communications reasonably necessary to perform or complete requested service through a legally permitted method.
The customer may request a paper or downloadable copy through the current contact method shown on the work order, invoice, or website.
Indicating an interest in Acima or accepting these Sales and Service Terms is not acceptance of a lease or credit agreement, authorization for an application or credit inquiry, or consent to a recurring debit. Any required application consent, separate agreement, payment authorization, or provider acknowledgment must be completed through the applicable process.
Phone-Bot Scheduling Texts — Terms & Privacy
Effective September 4, 2026. This optional program is offered by Simpson Maintenance LLC, doing business as Northwest Appliances. When scheduling texts are available, callers may ask our phone assistant for one text containing our official scheduling link. This is separate from the optional updates and offers program below.
Your choice: We ask for your affirmative verbal permission after explaining the texting program. No, silence, or an unclear response is not permission. Consent is not a condition of purchasing or receiving service. Declining a text does not delete a saved service request. This program sends one scheduling-link text per request, not recurring advertisements, marketing messages, or login codes. Message and data rates may apply.
Stop or get help: Reply STOP to opt out or HELP for help. You may reply START to re-enable texting after an opt-out; doing so does not request a new scheduling link or enroll you in marketing. For assistance, call (205) 712-1056 Monday–Friday, 8 a.m.–5 p.m. Central, or visit our contact page. A keyword request may receive a confirmation or help reply. Carriers are not liable for delayed or undelivered messages.
Requests and replies: A saved phone request or a date selected through the link is requested—not confirmed until our office confirms it. Replies to the bot’s text number are saved for office review; this is not a live text-chat service or an emergency channel. A text alone does not cancel or change an existing appointment. Call the office for urgent service questions.
Mobile information and privacy: We use the phone number, permission record, message-delivery information, and any text reply to provide the requested communication, honor opt-outs, and assist with your service request. These records are accessible through our private office inbox and necessary service-provider systems. We do not sell mobile information or share mobile numbers, text-message opt-in data, or consent with third parties or affiliates for marketing or promotional purposes. This restriction does not prevent necessary processing by providers that deliver or support the requested messaging service, subject to appropriate safeguards. The general Customer Information and Privacy section above describes our record-handling and privacy-request practices.
Optional Automated Updates, Appliance Tips & Offers
Optional email and text communications from Northwest Appliances may include appointment reminders, technician-arrival notices, routine parts and work-order updates, appliance-care tips, maintenance reminders, membership information, and occasional special offers.
Your choice: Receiving these messages is optional and requires your separate, affirmative consent. Consent is not a condition of purchasing or receiving service. Reading these terms does not enroll you in optional communications.
Text and email preferences: Where offered, text messages may use automated technology. Message frequency varies; message and data rates may apply. You may revoke text-message consent by replying STOP to a supported text message or contacting Northwest Appliances. You may unsubscribe from promotional emails using the unsubscribe link or by contacting Northwest Appliances.
Customers who do not enroll may still receive communications through a legally permitted method when reasonably necessary to schedule, perform, bill for, or complete requested service, including estimates, invoices, safety notices, and warranty information.
